Whiplash Injuries
In 2004 the Alberta Government set a cap on whiplash associated injuries that are a result of motor vehicle accidents. This cap set a maximum amount that someone can receive as compensation for pain and suffering if they have a whiplash associated injury. This cap covers what are referred to as Grade I and II sprains, strains and whiplash. This cap is presently at approximately $5,000.00 and is adjusted each year for inflation.
Often insurance companies will try to convince a victim of a motor vehicle accident that their injuries fall under the $5,000.00 cap limit. Often injuries that initially appear as though they may fall under the cap end up being outside of the cap as the injury progresses. For example, if a whiplash injury becomes chronic in nature then it is no longer subject to the minor injury cap.
